PETPHI TERMS OF USE AND PRIVACY POLICY
Version 1.0, effective as of September 2, 2026.
PREAMBLE
SYNAPPS MOBILE CORP., a corporation organized and existing under the laws of [STATE AND COUNTRY OF INCORPORATION], with [OPERATING ESTABLISHMENT IN BRAZIL, IF APPLICABLE], hereinafter referred to as the "CONTROLLER", is the owner and operator of the PetPhi application, hereinafter referred to as the "APP", made available through the Apple App Store and Google Play.
This instrument, hereinafter referred to as the "TERMS", governs the conditions of use of the APP and the processing of personal data arising from it, in accordance with Law No. 13,709 of August 14, 2018 (Brazilian General Personal Data Protection Law, "LGPD"), the California Consumer Privacy Act and the California Privacy Rights Act ("CCPA/CPRA"), the United States state privacy and biometric data protection laws, Regulation (EU) 2016/679 ("GDPR"), and the review and privacy guidelines of the Apple App Store and Google Play.
The APP was conceived and developed by Synapps Mobile Corp. at the intersection of artificial intelligence engineering and ethology, the science of animal behavior. Its foundation rests on peer-reviewed scientific literature and on animal behavior databases of academic institutions, including institutional access to Cornell University databases, used as an ethological reference for the design of the behavioral categories and for the validation of the models, under their own licensing terms. No data of the USER or of the USER's animal is transferred to such institutions by reason of such access.
CHAPTER I. PRELIMINARY PROVISIONS
Clause 1. Purpose. The APP is intended for the real-time observation and interpretation of the behavior of dogs and cats in the USER's care, through the use of the camera and microphone of the mobile device, for the purpose of informing the USER, by notification, of the occurrence of relevant behavioral events, such as signs of pain or discomfort, vocalizations, changes in routine, interactions between animals, and physiological needs.
Clause 2. Acceptance. Creating an account or using the APP, by any means, constitutes full and unrestricted acceptance of these TERMS. A USER who does not agree with any of their provisions must refrain from using the APP.
Clause 3. Capacity. The APP is intended exclusively for natural persons with full legal capacity who are eighteen years of age or older. It is not directed to children, and the CONTROLLER does not knowingly collect personal data from children under thirteen years of age, in compliance with the Children's Online Privacy Protection Act (15 U.S.C. §§ 6501 to 6506). If the inadvertent collection of a child's data is verified, the CONTROLLER will promptly delete it.
Clause 4. Definitions. For the purposes of these TERMS, the following definitions apply:
I.USER: the natural person who creates an account and uses the APP;
II.ANIMAL: the dog or cat registered by the USER and subject to observation by the APP;
III.MONITORING DATA: the image frame or audio block captured by the device's camera or microphone during observation and processed transiently;
IV.DERIVED INFORMATION: the structured textual and numerical description extracted from the MONITORING DATA, comprising the detected species, the approximate position of the ANIMAL in the frame, the classified posture, the identified body signals, the vocalization class, the duration and time of the event, the inferred behavioral state, and the respective confidence level;
V.EVENT: the behavioral occurrence confirmed by the system as relevant, according to the criteria of the APP's multimodal fusion operator;
VI.IDENTITY SIGNATURE: the numerical vector representation, visual or acoustic, that individualizes the ANIMAL and allows it to be distinguished from other animals present in the same environment;
VII.BEHAVIORAL PROFILE: the set of statistical indicators that describe the ANIMAL's habitual behavior over time, used to detect individual deviations;
VIII.ARTIFICIAL INTELLIGENCE PROVIDER: the service provider engaged by the CONTROLLER to interpret EVENTS and to generate the VISUAL REFERENCE, as set forth in Chapter V;
IX.VISUAL REFERENCE: the structured textual description of the ANIMAL's stable visible features, such as size, coat colors and pattern, coat length, ears, tail, muzzle, eyes, and distinctive markings, generated once from the reference photographs provided by the USER at registration.
CHAPTER II. OPERATION OF THE APP AND USE OF THE CAMERA AND MICROPHONE
Clause 5. The visual nature of animal behavior. The behavior of dogs and cats is expressed predominantly through visual signals: body posture, the position of the ears and tail, gait, the distance kept from objects, people, and other animals, and movements of approach and withdrawal. Observing such signals is impossible without the use of the camera, which is why its use is an essential and inseparable element of the APP's purpose.
Clause 6. Rear camera. The APP uses the device's rear camera. While the USER operates the screen, the rear camera observes the environment in front of it, the area from which the ANIMAL usually approaches. Monitoring is always activated by a voluntary act of the USER.
Clause 7. Microphone. The ANIMAL's vocalizations, such as barking, yelping, whining, growling, meowing, purring, and hissing, convey behavioral information that the image does not contain, and they frequently occur when the ANIMAL is outside the camera's field of view. The microphone allows the APP to recognize the vocalization class and, progressively, the vocal identity of the ANIMAL. The microphone does not transcribe, interpret, or retain human speech.
Clause 8. Background operation. In order to remain useful while the USER uses the device for other purposes, the APP may maintain observation in the background, under the following terms:
I.the acoustic channel remains active when the APP is minimized, and the operating system displays the microphone use indicator throughout the entire period;
II.on devices and operating system versions that allow multitasking camera access, the APP may keep the camera active in a floating window while the USER uses other applications, with the window remaining visible on the screen and the operating system displaying the camera use indicator;
III.locking the screen ends camera access in all circumstances; the APP does not perform visual observation while the screen is locked;
IV.the APP informs the USER, in visible text, of what it is able to observe at each moment, and any silent degradation of capability is prohibited.
Clause 9. Interruption. The USER may end observation at any time, through the APP's controls, through the operating system's controls, or by revoking the camera and microphone permissions in the device settings.
CHAPTER III. PRINCIPLE OF NON-RETENTION OF IMAGES AND SOUNDS
Clause 10. The CONTROLLER does not record, store, back up, or transmit for storage purposes any MONITORING DATA. Camera frames and audio blocks are processed on the device itself, in volatile memory, and discarded immediately after the DERIVED INFORMATION is extracted. No audiovisual record of the USER's environment exists on any server of the CONTROLLER.
Clause 11. Only the DERIVED INFORMATION, of a textual and numerical nature, is retained, and it does not allow the reconstruction of the original image or sound.
Clause 12. Controlled exception for the interpretation of EVENTS. Once an EVENT is confirmed, and only then, the APP may transmit to the ARTIFICIAL INTELLIGENCE PROVIDER, over an encrypted connection, up to five reduced-resolution frames, cropped, whenever technically possible, to the region of the ANIMAL, accompanied by a short audio excerpt. Such elements are intended exclusively for generating the structured description of the EVENT and are not stored, indexed, or reused by the CONTROLLER for any other purpose.
Clause 13. Registration photographs. The reference photographs that the USER, by the USER's own act, provides when registering the ANIMAL so that the APP can learn to recognize it are distinct from MONITORING DATA. They are processed only once, at registration, to generate the ANIMAL's VISUAL REFERENCE and IDENTITY SIGNATURES, and are then discarded. The CONTROLLER does not store them. The VISUAL REFERENCE and the IDENTITY SIGNATURES are linked exclusively to the USER's account, are used only for the individual identification of the ANIMAL, and may be replaced by the USER at any time by submitting new photographs, or deleted. The ANIMAL's profile photograph, if the USER chooses one, is stored only to be displayed in the APP.
Clause 14. Excerpts preserved by the USER. If the USER chooses, by express action, to preserve an audiovisual excerpt of an EVENT, the recording will be made exclusively on the USER's device, in its gallery, under the USER's full control. The CONTROLLER does not receive a copy of the preserved excerpt.
Clause 15. People and other animals present in the environment. The camera and microphone may incidentally capture people and other animals present in the environment. The APP does not perform identification, facial recognition, voice recognition, or any form of human biometrics, and it does not retain MONITORING DATA. The USER is responsible, however, for using the APP in accordance with applicable law and with the consent of any people present, particularly in jurisdictions that require the consent of all parties for the capture of oral communications, as set forth in Clause 45.
CHAPTER IV. PERSONAL DATA PROCESSED
Clause 16. Categories of data. The CONTROLLER processes the following categories of data:
I.account data, comprising name, email address, the authentication identifier with the identity provider chosen by the USER, and the device notification token, provided by the USER or generated by the system, for creating and maintaining the account and for sending notifications;
II.ANIMAL data, comprising name, species, approximate age, VISUAL REFERENCE, profile photograph, if any, and communication preferences, provided by the USER or generated from the USER's photographs, for individual identification and personalization of messages;
III.DERIVED INFORMATION, generated by the APP from the camera and microphone without retention of MONITORING DATA, for notifying the USER, individual training, and aggregate research;
IV.IDENTITY SIGNATURES, derived from the registration photographs and from the ANIMAL's vocalizations, for recognizing which animal is being observed in environments with more than one;
V.BEHAVIORAL PROFILE, derived from the DERIVED INFORMATION, for detecting deviations from the ANIMAL's own habitual behavior;
VI.confirmations and corrections provided by the USER regarding the notifications received, for calibrating the system's confidence and improving the individual model;
VII.technical data, comprising the device model, operating system version, APP version, battery status and thermal status, the latter two used exclusively to regulate energy consumption, and error logs, for operation, security, and diagnostics.
Clause 17. Data not collected. The CONTROLLER does not collect geolocation data, contacts, browsing history, data from other applications, advertising identifiers, human biometric data, human health data, or financial data, except, with respect to the latter, data processed strictly by the app stores in connection with any subscription.
Clause 18. Sensitive personal data. The CONTROLLER does not intentionally collect sensitive personal data, within the meaning of Article 5, item II, of the LGPD and Article 9 of the GDPR. DERIVED INFORMATION relates to the ANIMAL, not to the USER. Any incidental capture of the USER's sensitive personal data, such as the content of human speech in an audio excerpt of an EVENT, is not transcribed, extracted, or retained.
CHAPTER V. PURPOSES, LEGAL BASES, AND SERVICE PROVIDERS
Clause 19. Purposes and legal bases. Data is processed for the purposes and on the legal bases listed below:
I.provision of the service, comprising observation, notification, and account maintenance, on the basis of the performance of a contract, under Article 7, item V, of the LGPD and Article 6(1)(b) of the GDPR;
II.individual training of the ANIMAL's model, on the basis of the performance of a contract and the CONTROLLER's legitimate interest, under Article 7, items V and IX, of the LGPD and Article 6(1)(b) and (f) of the GDPR;
III.scientific research on animal behavior, carried out exclusively on aggregated DERIVED INFORMATION dissociated from the USER, on the basis of studies conducted by a research body and legitimate interest, under Article 7, items IV and IX, and Article 7, paragraph 4, in conjunction with Article 12, of the LGPD, and Article 6(1)(f), in conjunction with Article 89, of the GDPR;
IV.transmission of frames to the ARTIFICIAL INTELLIGENCE PROVIDER for the interpretation of EVENTS, and of registration photographs for the generation of the VISUAL REFERENCE, on the basis of the performance of a contract;
V.information security, fraud prevention, and technical diagnostics, on the basis of legitimate interest;
VI.compliance with a legal or regulatory obligation, under Article 7, item II, of the LGPD and Article 6(1)(c) of the GDPR;
VII.operation of the camera and microphone in the background, on the basis of the USER's specific, prominent, and revocable consent, under Article 7, item I, of the LGPD and Article 6(1)(a) of the GDPR, obtained after a prominent disclosure within the APP, in accordance with the Google Play User Data policy.
Clause 20. Withdrawal of consent. Consent for background operation may be withdrawn at any time in the APP's settings, without affecting the lawfulness of processing carried out on the basis of consent previously given.
Clause 21. Scientific research. Data intended for research is limited to DERIVED INFORMATION. Before any use for that purpose, the CONTROLLER removes account and device identifiers and aggregates the data, so that it cannot reasonably be associated with the USER. Any resulting scientific publications will not contain individualized data.
Clause 22. Service providers. The CONTROLLER uses service providers, qualified as operators under the LGPD, processors under the GDPR, and "service providers" under the CCPA/CPRA, strictly necessary for the operation of the APP, which process data exclusively according to its instructions, under contract, and are prohibited from using it for their own purposes. They are:
I.Google LLC, as provider of the Firebase platform, for authentication, storage of account data, DERIVED INFORMATION, VISUAL REFERENCES, and profile photographs, and delivery of notifications;
II.Google LLC, as provider of the Google Cloud platform and the Gemini artificial intelligence models, for the interpretation of confirmed EVENTS, the generation of notification messages, and the generation of the VISUAL REFERENCE, receiving the elements referred to in Clauses 12 and 13;
III.Apple Inc., as provider of the iOS notification service;
IV.Google LLC, as provider of the Android notification services.
Clause 23. Contractual regime of the ARTIFICIAL INTELLIGENCE PROVIDER. Frames and registration photographs are transmitted to the ARTIFICIAL INTELLIGENCE PROVIDER exclusively under a contractual arrangement in which the inputs provided are not used by the provider to train or improve its models and are retained by it only for the period strictly necessary for processing and for compliance with legal obligations, in accordance with the enterprise terms of service applicable to it.
Clause 24. Prohibition on the sale of data. The CONTROLLER does not sell, rent, assign, or share personal data with third parties for advertising, third-party marketing, data brokerage, or cross-context behavioral advertising purposes, within the meaning of the CCPA/CPRA. The APP does not display advertisements and does not use advertising trackers. The CONTROLLER does not request the tracking authorization provided for in Apple's App Tracking Transparency framework, because it does not engage in tracking.
Clause 25. Mandatory disclosures. The CONTROLLER may disclose data when required by law, by court order, or by a competent authority, or when necessary to protect the rights, security, and integrity of the APP, always to the extent strictly necessary.
Clause 26. Succession. In the event of a merger, acquisition, spin-off, or any corporate reorganization, data may be transferred to the successor, which will be bound by these TERMS or by at least equivalent conditions, with prior notice to the USER.
CHAPTER VI. INDIVIDUAL TRAINING
Clause 27. The APP learns the USER's ANIMAL: its appearance, its voice, its habitual behavioral repertoire and, progressively, what constitutes normality for it. This learning is individual and linked to the USER's account, and it is what makes it possible to distinguish the ANIMAL from another present in the same environment and to detect that a behavior has departed from that individual's pattern.
Clause 28. IDENTITY SIGNATURES and the BEHAVIORAL PROFILE are numerical representations, do not allow the reconstruction of images, and have no utility outside the context of the ANIMAL to which they refer.
Clause 29. Individual training is carried out from the DERIVED INFORMATION and the USER's confirmations, and it neither requires nor performs the retention of MONITORING DATA.
CHAPTER VII. RETENTION AND DELETION
Clause 30. Retention periods. Data is retained for the following periods:
I.MONITORING DATA: not retained, being discarded from memory after the DERIVED INFORMATION is extracted;
II.frames transmitted to the ARTIFICIAL INTELLIGENCE PROVIDER and registration reference photographs: not retained by the CONTROLLER, the photographs being discarded once the VISUAL REFERENCE and IDENTITY SIGNATURES are generated, and both being subject to the provider's transient retention policy, as set forth in Clause 23;
III.DERIVED INFORMATION, VISUAL REFERENCE, profile photograph, IDENTITY SIGNATURES, and BEHAVIORAL PROFILE: for as long as the account exists, or until the USER deletes them;
IV.account data: for as long as the account exists and, after its deletion, for up to thirty days in backups;
V.research data, aggregated and dissociated: for an indefinite period, as it does not constitute personal data;
VI.technical and security logs: for up to twelve months.
Clause 31. Account deletion. The USER may delete the account at any time within the APP, in accordance with Guideline 5.1.1(v) of the App Store Review Guidelines and the corresponding Google Play policy. Deletion results in the removal of account data, ANIMAL data, VISUAL REFERENCES, profile photographs, IDENTITY SIGNATURES, the BEHAVIORAL PROFILE, and the associated DERIVED INFORMATION within up to thirty days, except for retention required by law. Data already aggregated and dissociated for research purposes is not affected by deletion, as it does not constitute personal data.
CHAPTER VIII. INFORMATION SECURITY
Clause 32. The CONTROLLER adopts technical and administrative measures consistent with the state of the art, comprising encryption of data in transit, using TLS protocol version 1.2 or higher, and at rest; authentication through identity providers with verification; per-account access control, so that each USER accesses only their own data; the principle of least privilege; logging and monitoring of access; and on-device processing as the rule, with the consequent reduction of the exposure surface.
Clause 33. Keys and credentials for access to service providers are not embedded in the APP installed on the USER's device.
Clause 34. Recognizing that no system is infallible, in the event of a security incident that may result in relevant risk or harm to the USER, the CONTROLLER will notify the USER and the competent authorities, including the Brazilian National Data Protection Authority, under Article 48 of the LGPD, and United States state authorities where applicable, within the legal deadlines.
CHAPTER IX. INTERNATIONAL TRANSFERS
Clause 35. The CONTROLLER is headquartered in the United States of America and operates in Brazil. Data may be stored and processed in the United States and in the other jurisdictions in which the service providers referred to in Clause 22 operate.
Clause 36. For data subjects residing in Brazil, international transfers are based on Article 33 of the LGPD, through contractual clauses and adequate safeguards, or on the data subject's specific consent, where applicable.
Clause 37. For data subjects residing in the European Union, the European Economic Area, or the United Kingdom, transfers rely on the Standard Contractual Clauses approved by the European Commission and on supplementary safeguards, under Chapter V of the GDPR.
CHAPTER X. DATA SUBJECT RIGHTS
Clause 38. Data subjects residing in Brazil. Under Article 18 of the LGPD, the USER has the right to obtain from the CONTROLLER confirmation of the existence of processing; access to the data; correction of incomplete, inaccurate, or outdated data; anonymization, blocking, or deletion of unnecessary or excessive data or data processed in breach of the law; portability; deletion of data processed on the basis of consent; information about the sharing carried out; information about the possibility of not providing consent and the consequences of refusal; withdrawal of consent; and objection to processing carried out in breach of the law. The USER may also file a petition with the Brazilian National Data Protection Authority.
Clause 39. Residents of California and other United States states with privacy legislation. Under the CCPA/CPRA and similar state laws, the USER has the right to know the categories of personal data collected, their sources, the purposes of processing, and the third parties with whom they are shared; to access the data and obtain a copy; to correct it; to delete it; to portability; to opt out of the sale or sharing of personal data, activities in which the CONTROLLER does not engage; to limit the use of sensitive personal information, which the CONTROLLER does not intentionally collect; and not to be discriminated against for exercising these rights. The USER may designate an authorized agent to exercise these rights. The CONTROLLER will respond within forty-five days, extendable by an equal period upon notice.
Clause 40. Data subjects residing in the European Union, the European Economic Area, and the United Kingdom. Under Articles 15 to 22 of the GDPR, the USER has the rights of access, rectification, erasure, restriction of processing, portability, and objection, as well as the rights relating to automated individual decision-making, and the right to lodge a complaint with the competent supervisory authority.
Clause 41. Exercise of rights. Rights may be exercised within the APP or by writing to the email address indicated in Chapter XVII. The CONTROLLER may request reasonable information to verify the identity of the requester. Exercising these rights is free of charge.
Clause 42. Automated decisions. The APP's notifications are generated automatically from behavioral analysis, are merely informative in nature, produce no legal effects with respect to the USER, and do not replace human or professional judgment. The USER may contest or correct any notification within the APP, and the correction will feed the calibration of the system.
CHAPTER XI. PROVISIONS SPECIFIC TO THE UNITED STATES OF AMERICA
Clause 43. Notice at collection. In compliance with the CPRA, the categories of personal data collected, the purposes of processing, and the retention periods are described in Chapters IV, V, and VII. The CONTROLLER does not sell or share personal data and does not intentionally collect sensitive personal information.
Clause 44. Human biometrics. The APP does not collect, capture, purchase, receive, or store biometric identifiers or biometric information of human beings, within the meaning of the Illinois Biometric Information Privacy Act and similar laws of the States of Texas and Washington. There is no facial recognition, facial geometry extraction, human voiceprint, or any biometric model of people. The IDENTITY SIGNATURES processed by the APP refer exclusively to animals.
Clause 45. Consent to audio capture. Several United States states, including California, Florida, Illinois, Maryland, Massachusetts, Pennsylvania, and Washington, require the consent of all parties for the capture of oral communications. Although the APP does not record or retain human conversations, the microphone captures the environment. By activating the microphone, especially in the background, the USER assumes responsibility for ensuring that such use is lawful at the location and for informing the people present.
Clause 46. Other provisions. In compliance with Section 1798.83 of the California Civil Code, the CONTROLLER declares that it does not disclose personal data to third parties for their direct marketing purposes. The CONTROLLER does not track users across third-party websites or applications, and Global Privacy Control signals are honored by the absence of any sale or sharing to opt out of. The CONTROLLER will disclose annually, when required, the metrics relating to privacy requests received and fulfilled.
CHAPTER XII. PROVISIONS SPECIFIC TO BRAZIL
Clause 47. The CONTROLLER acts as the controller of the personal data processed by the APP, within the meaning of Article 5, item VI, of the LGPD. The Data Protection Officer (Encarregado) may be contacted at the address indicated in Chapter XVII.
Clause 48. Processing observes the principles set forth in Article 6 of the LGPD: purpose, adequacy, necessity, free access, data quality, transparency, security, prevention, non-discrimination, and accountability.
Clause 49. The USER may file a complaint with the Brazilian National Data Protection Authority.
CHAPTER XIII. ANIMAL WELFARE AND PROHIBITED CONDUCT
Clause 50. Foundation. The APP exists for the benefit of the animal. Its purpose is to enable the USER to understand the ANIMAL's behavior and respond to its needs, and never to serve as an instrument for provoking, manipulating, or exploiting behavioral reactions. The CONTROLLER recognizes that legitimate ethological observation is non-intrusive observation, and that the artificial induction of behavior corrupts the data, harms the animal, and distorts the service.
Clause 51. Prohibited conduct. The USER is expressly prohibited, under penalty of the sanctions provided for in this Chapter, from:
I.provoking, inducing, stimulating, or conditioning in the ANIMAL, by any means, reactions of fear, stress, anxiety, pain, aggression, defense, or panic, for the purpose of obtaining readings, notifications, or interpretations from the APP;
II.subjecting the ANIMAL to aversive stimuli, noises, objects, substances, or situations intended to trigger vocalizations or behaviors that would not otherwise occur;
III.using the APP as an instrument to test, prove, or demonstrate the ANIMAL's response to mistreatment, deprivation, or confrontation, even under the justification of curiosity, entertainment, or verification of the system's accuracy;
IV.deliberately provoking or allowing confrontations between animals in order to obtain interaction readings;
V.depriving the ANIMAL of food, water, rest, or elimination for the purpose of observing, through the APP, the corresponding behavioral manifestations;
VI.using the APP to monitor people, or for any purpose unrelated to the observation of animals in the USER's care;
VII.committing, with respect to the ANIMAL, any act that constitutes mistreatment, abuse, cruelty, or neglect, within the meaning of Article 32 of Law No. 9,605 of February 12, 1998, the animal protection laws of the United States states, and other rules applicable at the place of use.
Clause 52. Investigation. The APP's system is structured to recognize, from the DERIVED INFORMATION, behavioral patterns incompatible with non-intrusive observation, such as the anomalous recurrence of states of fear, threat, or pain, the systematic correlation of such states with the presence or action of the USER, the absence of affiliative manifestations over time, and the frequency of confrontations between animals. The identification of such patterns will give rise to a review of the account by the CONTROLLER, which may request clarification from the USER.
Clause 53. Sanctions. If any of the conduct prohibited in Clause 51 is found to have occurred, the CONTROLLER may, at its sole discretion and without prejudice to other applicable measures, warn the USER, temporarily suspend the account, or terminate it permanently, banning the USER from the APP.
Clause 54. Application to paying users. The sanctions provided for in Clause 53 apply in full to users holding a subscription or any paid plan. Paying status does not grant the USER immunity, priority, or differentiated treatment with respect to compliance with the provisions of this Chapter. Termination of the account for violation of this Chapter does not give rise to a refund of amounts relating to the period already paid, except where a refund is required by a mandatory consumer protection rule or by the policies of the app store through which the subscription was purchased.
Clause 55. Reporting to authorities. Where there is evidence of mistreatment, the CONTROLLER may report the matter to the competent authorities, providing them with the relevant DERIVED INFORMATION and the USER's account data, to the extent required or authorized by applicable law, on the basis of compliance with a legal obligation and the legitimate interest in the protection of animals.
Clause 56. Data of accounts terminated for violation. Data of accounts terminated for violation of this Chapter may be retained for the period necessary to prevent new registration by the same USER, to respond to requests from authorities, and for the regular exercise of rights by the CONTROLLER, subject to legal deadlines.
CHAPTER XIV. NATURE OF THE SERVICE AND ITS LIMITATIONS
Clause 57. The APP is an assisted observation tool. It does not provide veterinary services, does not make diagnoses, does not prescribe treatment, and does not replace consultation with a veterinarian. Notifications are probabilistic inferences obtained from observable signals and are presented with their respective confidence level. Persistent signs, sudden changes, or any concern regarding the ANIMAL's health must be referred to a qualified professional.
Clause 58. The APP may fail to detect events or may report events that do not correspond to a real situation. Lighting, framing, ambient noise, distance, occlusion, screen locking, and restrictions imposed by the operating system affect the ability to observe. The APP must not be used as the sole means of supervising an animal at risk.
Clause 59. The APP indicates, at each moment, the scope of its observation, showing whether the camera and microphone are operating, only the microphone, or neither. The USER is responsible for taking this information into account when relying on the monitoring.
Clause 60. Epistemological distinction. In its notifications, the APP distinguishes what it observes from what it interprets. A directly measured physical signal is reported as an observation. A physiological or affective state inferred from observable evidence is reported as an inference, with the appropriate qualification. A reading of a relational or longitudinal nature is reported as an interpretation, with a reinforced qualification. The APP does not assert any mental state of the ANIMAL as fact.
First Paragraph. Dogs and cats do not communicate through human language, and, in the current state of scientific knowledge, there is no method capable of reproducing exactly what an animal thinks or feels. The APP does not translate thoughts. Communication between humans and animals is, and has always historically been, an approximation built from the observation of signals: people do not bark or meow, and yet they establish real forms of understanding with their animals. The APP belongs to that tradition, with the rigor of science.
Second Paragraph. All information issued by the APP corresponds to what the scientific literature in ethology, animal behavior, bioacoustics, and veterinary science associates with the signals observed in that context, also taking into account the individual profile provided by the USER and the ANIMAL's own history. It is the most probable reading according to available knowledge, and not a certainty about the ANIMAL's internal state. The message may not correspond to what the ANIMAL is actually experiencing.
Third Paragraph. The subjective states of animals are not directly accessible to human or technological observation. The APP operates at the limit of what science allows to be inferred from behavior, posture, vocalization, and context, and not beyond it. The USER declares that they understand that this is the maximum scope of the service.
Fourth Paragraph. Notifications written in the first person, as if the ANIMAL were addressing the USER, are a language device intended to make the information accessible and relatable. They do not represent the reproduction of the ANIMAL's words, thoughts, or intentions.
Fifth Paragraph. No notification from the APP constitutes a veterinary diagnosis, report, or opinion, subject to the provisions of Clause 57.
CHAPTER XV. LICENSE OF USE AND INTELLECTUAL PROPERTY
Clause 61. The CONTROLLER grants the USER a personal, limited, non-exclusive, non-transferable, and revocable license to install and use the APP on devices owned or controlled by the USER, for personal and non-commercial purposes, under the terms of this instrument and the rules of the app stores.
Clause 62. The APP, its source code, its models, its algorithms, including its proprietary behavioral fusion operator, its taxonomies, its trademarks, and its content belong to the CONTROLLER or its licensors and are protected by intellectual property law. Copying, modifying, decompiling, reverse engineering, extracting models or training data, or creating derivative works is prohibited, except in the cases expressly authorized by law.
Clause 63. The USER retains ownership of the registration photographs and of the information the USER provides, granting the CONTROLLER a limited license to process them under the terms of this instrument. DERIVED INFORMATION, when aggregated and dissociated from the USER, does not constitute personal data and may be used by the CONTROLLER for research and improvement of the service.
CHAPTER XVI. CONDITIONS OF USE, DISCLAIMERS, AND LIMITATION OF LIABILITY
Clause 64. Obligations of the USER. The USER undertakes to use the APP exclusively for the observation of animals in the USER's care; to refrain from capturing audio or images in breach of the law or without the required consent of the people present; not to circumvent technical or security controls; not to use the APP for any unlawful or abusive purpose or one harmful to animals or people; and to keep the USER's credentials confidential.
Clause 65. No warranties. The APP is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, the CONTROLLER does not warrant that the APP will operate uninterrupted or error-free, nor that it will detect all relevant events.
Clause 66. Limitation of liability. To the maximum extent permitted by applicable law, the CONTROLLER will not be liable for indirect, incidental, special, consequential, or punitive damages, including injury to or death of an animal, arising from the use of or inability to use the APP, or from reliance on its notifications as the sole means of supervision.
Clause 67. Mandatory rules. No provision of this instrument excludes or limits any liability that cannot be excluded or limited by law, and the consumer rights guaranteed by Law No. 8,078 of September 11, 1990, and by applicable United States consumer protection laws are preserved.
CHAPTER XVII. FINAL PROVISIONS
Clause 68. System permissions. The APP requests the following permissions: camera, for observing the environment; microphone, for recognizing vocalizations, including in the background; notifications, for delivering alerts; and saving to the gallery, exclusively for the case provided for in Clause 14. Background use on Android is carried out through a foreground service with a visible persistent notification, in accordance with the Android foreground services policy. On iOS, the declared background modes and the system's privacy indicators are observed.
Clause 69. Prominent disclosure. Before the first activation of monitoring and before enabling background use, the APP will display, on its own screen separate from these TERMS, a clear disclosure of the type of data accessed, the purpose, and the possibility of capture when the APP is not in use, requesting the USER's affirmative consent, in accordance with the Google Play User Data policy. The categories declared in the Apple App Store privacy label and in the Google Play Data safety section correspond to the categories listed in Clause 16, indicating that monitoring audio and video data is processed ephemerally and not collected, and that no data is used for tracking.
Clause 70. Amendments. The CONTROLLER may update these TERMS to reflect changes to the APP, to the law, or to its practices. Material changes will be communicated within the APP at least fifteen days in advance, and those that expand the processing of data or require new consent will only take effect after the USER's acceptance. The current version will remain available in the APP and at petphi.com.
Clause 71. Governing law and jurisdiction. For USERS residing in Brazil, Brazilian law applies, and the courts of the USER's domicile are chosen as the forum, under Law No. 8,078 of 1990. For USERS residing in the United States of America, the law of the State of Delaware applies, without prejudice to the public policy consumer protection rules of the USER's state of residence.
Clause 72. Severability. The invalidity or unenforceability of any provision of these TERMS will not affect the remaining provisions, which will remain in full force and effect.

Text displayed on its own screen, before the first activation of monitoring, with options to accept and to decline:
"PetPhi uses your device's rear camera and microphone to observe your animal's behavior. Images and sounds are processed on your device and are not recorded or stored. Only a description of what was observed remains, such as the animal's posture, vocalization, or gait. When a relevant event is confirmed, a few reduced-resolution frames may be sent, encrypted, to our artificial intelligence provider for interpretation, and they are not kept. In the background, the microphone stays active to recognize vocalizations; the camera stays active only when your device allows it, in a floating window, and it stops when the screen is locked. The system shows an indicator whenever the camera or microphone is in use. PetPhi does not identify people. If other people are present, let them know. PetPhi does not translate thoughts: dogs and cats do not speak our language, and what the app communicates is what scientific studies associate with the observed behavior, the most probable reading and not a certainty. All of these functions can be turned off at any time in Settings."
System permission request texts:
Camera: "The rear camera observes the environment to recognize your animal's behavior and let you know when something relevant happens. Images are processed on your device and are not stored."
Microphone: "The microphone recognizes your animal's vocalizations to let you know, even when the app is in the background. It does not transcribe human speech."
Gallery: "Used only if you choose to save an excerpt of an event to your gallery."
Android foreground service notification: "PetPhi is observing your animal. Tap to see what is being observed or to pause."
